INTRODUCTION
You accept these terms and conditions (agreement) by using the website and/or when you as a customer make a purchase on se.2xu.com, no.2xu.com, dk.2xu.com, fi.2xu.com or baltics.2xu.com and an agreement with KMP Online AB, organization number 559069-5945 is established. When an order is received, an order receipt is automatically sent by e-mail to the e-mail address you entered at the checkout. The e-mail contains information about your order, such as delivery address, products, prices and shipping costs. If something is wrong with the order, you should contact us as soon as possible via e-mail info.nordics@2xu.com.
These general terms and conditions on the website have been prepared for online purchases of goods and the EU General Data Protection Regulation (GDPR) are applied in them.

Summary of the agreement:
- We only ship to Sweden, Norway, Denmark, Finland, Estonia, Lithuania and Latvia.
- You have a 30-day right to return and change of mind return.
- We do not enter into agreements with minors (under 18 years of age) without the parent’s approval.
- All personal data will be handled by KMP Online AB and 2XU Pty Ltd who are jointly responsible for personal data.
- Events beyond our control shall be considered force majeure.
- The price of the product is what is displayed in the online store on the date you place the order.
- Shipping costs and payment fees are recognized before confirming the purchase.
- We reserve the right to amend any information without prior notice.
- Normal delivery time is 3-7 weekdays, depending on where you live. There may be longer delivery times during promotions and sales.
- We use Shopify Payments, and offer card payments in all countries. There might be more payment options available, depending on the country you live in. Card information is transmitted over secure SSL encryption and is not stored by us.
- The customer must enter the following information when ordering: name, address, mobile phone number, e-mail address and, if necessary, social security number (only for payment with Klarna invoice or partial payment).

KMP Online AB operates se.2xu.com, no.2xu.com, dk.2xu.com, fi.2xu.com, baltics.2xu.com and holds the rights to sell and distribute 2XU in Sweden, Norway, Denmark, Finland, Estonia, Lithuania and Latvia. Sportswear and accessories of the 2XU brand are sold at the named sites. KMP Online AB is part of MnO International AB (556497-9457).
Sellers are mentioned below as “KMP Online AB”, “2xu.com”, “our” and “we”. The buyer is the person who makes the order, mentioned below as “the customer”, “you” and “yours”.
ESTABLISHMENT OF PURCHASE AGREEMENT AND CONFIRMATION OF ORDER
By placing an order on se.2xu.com, no.2xu.com, dk.2xu.com, fi.2xu.com or baltics.2xu.com, you accept these terms, and a binding agreement arises. When an order is received, an order receipt is automatically sent to the e-mail address you entered at checkout. The e-mail contains all information about your order, such as delivery address, products, prices and shipping costs. If something is wrong with the order, you should contact us as soon as possible via e-mail info.nordics@2xu.com.
We reserve the right not to be able to make delivery in cases where goods are out of stock or stock has been incorrect. We do not enter into agreements with minors (under 18 years of age) without the parent’s approval. We only ship to Sweden, Norway, Denmark, Finland, Estonia, Lithuania and Latvia. You cannot order from se.2xu.com, no.2xu.com, dk.2xu.com, fi.2xu.com and baltics.2xu.com if you live in another country. If you live in another country, than stated above, please visit 2xu.com for your local 2XU provider.
PRICES
All prices stated are in local currency and include local VAT. The total cost the customer must pay, including all fees and delivery costs as well as the specification of the individual products in the total price is stated in the shopping cart at checkout before the order is completed.
We reserve the right to make typos and technical problems in connection with orders and price indications. We reserve the right to terminate purchase agreements for incorrect orders and prices. A product that has already been sent from our warehouse is not affected by a possible increase or decrease in the price that occurs after the order, e.g. in the form of sales, promotions, discount codes or changes in pricing.
Promotions and discount codes
Promotions are time-limited. When using discount codes, they are usually only valid for one purchase and cannot be combined with other offers. The customer can use only one discount code per order and several discount codes cannot be combined. Check that the price is correct before you complete your purchase, this can be done at checkout after you have entered your discount code. We reserve the right to cancel a purchase in the event of misuse / improper use of a discount code and it is not possible to receive cash payment of a discount code.
The validity period is announced in connection with the campaign and the value of the discount code is distributed between the ordered products. Upon return of the products, the discount cannot be refunded and the code cannot be reused.
Please note that we can not add a discount code afterwards. If you have problems adding a discount code at checkout, please contact us before you make the purchase, as we do not have the opportunity to deduct the discount afterwards.
PAYMENT
All products remain 2XUs property until full payment is made. All transfers conducted on this website are handled and transacted through Shopify Payments that is certified with Level 1 PCI DSS (Payment Card Industry Data Security Standard) to guarantee your protection. Card information is not stored by us after the transaction is completed.
This website uses TLS (Transport Layer Security) or also known as SSL (Secure Socket Layer) certificate which is a protocol for secure data transfer. By entering information at checkout and by making a purchase, you accept these terms.
We offer different payment methods, depending on the country you live in. Follow the instructions at checkout for each payment method.
We offer card payment (Visa, MasterCard) in all countries. There are no additional fees for card payments. Card number, card validity, CVC2/CVV2 code and for each card a so-called 3D Secure code must be stated. The amount will be reserved immediately and deducted in connection with the order being sent from our warehouse.
In some countries, Klarna invoice payment, Klarna direct payment and Klarna partial payment are also offered. When choosing Klarna, you accept Klarna AB's (556737-0431, Sveavägen 46, 111 34 Stockholm), terms of use, data protection information and cookie policy. You will receive payment information immediately after the purchase from Klarna.
If you have ordered several items and one or more of the items are sold out, we will only charge the amount of the items sent.
PRODUCT INFORMATION
We reserve the right to make typing errors on this website and against selling sold out products. We do not guarantee that the images reflect the exact appearance of the products as a certain colour difference may occur depending on the screen, photo quality and resolution. All image information should be considered as illustrations and cannot be guaranteed to reflect the product’s exact appearance and properties.
DELIVERY
We cooperate with Postnord for deliveries. You can have your order sent to your nearest postal office or pickup locker. You will receive a notification via SMS for collection of your package. Delivery time is normally 3-7 working days from the time we have confirmed your order. During long weekends, your order takes a few extra days. Orders placed on the weekend are normally shipped the following Monday.
In connection with your order being sent from our warehouse, an e-mail for shipping confirmation will be sent to the given e-mail address. The order should then reach you within 3-7 working days, depending on where you live. If you have not received your delivery within 7 working days, we ask you to contact our customer service at info.nordics@2xu.com. We cannot guarantee delivery time frames will be met but will do our best.
Transport damage / Examination of the product
We take responsibility for products that are damaged or lost during delivery to you. If you discover that the product you receive is damaged in transport, or if you discover that an item is missing due to packaging damaged in transport, you must make a complaint within 24 hours of when you received the package, if it is a visible damage. It is therefore important that you check your shipment when receiving the package so that it is not damaged in transport. Please make a complaint no later than 24 hours after receiving the package directly via Postnord's website https://portal.postnord.com/claimspublic/. Then contact our customer service at info.nordics@2xu.com and enter your case number that you received via Postnord's website to us, and we will take your case further with Postnord. Please keep postal packaging and the product packaging in the event of transport damage.
RIGHT OF CHANGE OF MIND RETURN OR CHANGE OF GOODS
You have the right to change your mind of your purchase within 14 days of receiving your order. For you to feel secure with your purchase, we offer instead a 30-day right to return from the time you receive your order.
You as a customer have the right to try and examine the product at home. Avoid wearing perfume or deodorant that may leave marks or odours on the product when trying it on. The right of return applies provided that the product is kept in unchanged condition and holds all original parts (notes, accessories, packaging, tags) as when you received your order. The product must be in the same condition as you received it, so it could be sold again. Note that we do not accept returns of socks and underwear for hygiene purposes. Swimwear with a broken hygiene seal cannot be returned for hygiene reasons. As long as the hygienic seal is still in place, it is possible to return swimwear.
If the quality of the product has been affected as a result of you as a customer having handled it more than is necessary, we have the right to deduct the refund corresponding to the depreciation of the product.
A delivery note with return information and a return shipping label are included in the package together with your products. Fill out your details and put it in the package together with the item you are going to return and place the return shipping label on the package. Please ask for a receipt of proof when dropping off your return at a checkpoint/postal agent, as proof of your return. You may not tape, put stamps, put return shipping labels or the like directly on the product’s original packaging. Therefore, it is important that outer postal packaging for shipping is used. Please use the same bag in which you received the order, as it can be resealed and thus minimize the environmental impact.
If you by chance did not receive a return shipping label or return note in your package, please contact customer service and we will help you. We do not stand accountable if you as a customer decide not to use the return shipping label made by us when you return your package. Products returned by cash on delivery are not approved by 2xu.com.
NOTE: Keep in mind that you can only leave your return at a post office that provides POSTNORD.
Refund
From the time we receive your return, it can take up to 14 working days for a refund to be issued, but we do our best to process each return as soon as we can. You will receive an email confirming that your return has been processed.
The refund will be made to the same payment method you used for the original order. It generally takes between 2-5 working days until the money is refunded. If you have chosen to pay by invoice, we recommend that you pay the invoice or contact Klarna to extend the payment time, to avoid the risk of unnecessary reminder fees.
Sometimes a return can be registered in different batches and it then takes up to 48 hours before your return is fully completed. In this case, you may receive two or more return confirmations.
Change of size
If you want to change the size, please fill out the return note that was sent in the package together with your products, as with all returns. Please place a new order with the preferred product. If you have purchased a discounted item and wish to change sizes, please email us before placing your new order and we will assist you. We are not able to credit discounts retrospectively on existing orders.
Items purchased from another retailer are not eligible to be returned to us. These must be returned to the place of purchase.
FAULTY ITEM
If you want to complain about a defective/faulty item, you can do so by sending an e-mail to us at info.nordics@2xu.com. Please state your order number, which item it is, what the defect of the item is and send with pictures of the defect. We will answer you before you send in the item to us. If the complaint is approved, we will send you further instructions via e-mail.
The right of complaint applies to production defects of goods and not defects caused by normal wear and tear. A complaint must be made as soon as possible after the defect has been discovered and according to law you have the opportunity to complain about an item for up to 2 years after purchase. See the section for “warranty” below to read more about the guarantees on our products.
Wetsuits: Be careful when putting on and taking off the suit. The neoprene is sensitive; if you tear the material with your nails, it can cause holes. If you as a customer cause a broken zip or holes in the wetsuit, the wetsuit is not covered by open purchase or complaint.
PRIVACY POLICY
We respect your privacy and are committed to protecting your personal information. Our privacy policy outlines our approach to privacy and how we collect, use and protect your personal information. It also sets out your rights in relation to accessing the personal information we collect and hold about you. We are bound by the General Data Protection Regulation (GDPR), as amended from time to time (collectively Regulation).
Personal information is defined in the Regulation and is information or an opinion about an identified individual or an individual who is reasonably identifiable. Examples include an individual’s name, address, contact number and email address.

Shared personal data responsibility
KMP Online AB, 559069-5945, Virkesvägen 1 a, 120 30 Stockholm, Sweden and 2XU Pty Ltd, ABN 85 112 308 602, 23 Ceremore Street, Ceremore VIC 3121, Australia are jointly responsible for the processing of your personal data. KMP Online AB and 2XU Pty Ltd have established a special data sharing agreement. KMP Online AB and 2XU Pty LTD are responsible for ensuring that the personal data provided in connection with the order is handled in accordance with the Personal Data Protection Regulation (GDPR), hereinafter referred to as the Regulation. KMP Online AB is part of MnO International AB (556497-9457). Between KMP Online AB (subsidiary) and MnO International AB (parent company), certain information and documentation is also exchanged, including personal data.
2 How we collect personal information
We may collect personal information in a variety of ways, including when:
a) You visit and communicate with us via our website or social media
b) You place an order on the website
c) You sign up for our newsletter
d) You agree to receive SMS from us
e) You contact us by e-mail
f) You as a supplier or representative of these enter into cooperation with us
g) You apply for a position with us; and

The kinds of personal information that we collect and hold about you will depend on the circumstances of collection, including whether we collect the information from you as a consumer, reseller, partner, job applicant, newsletter subscriber or in some other capacity. For example, if you have placed an order via the online store, we may collect:

d) Other information in connection with the purchase or which you may have provided in connection with you contacting us.

When you visit our website, we and/or third parties may place cookies on your browser to enhance and manage our website and improve our business and the services we provide to you. We, third parties and/or Google may use this information to optimize and place ads, including third party ads and remarketing ads based on past visits to this website, on our own and third party sites. Google’s ability to use and share information collected by Google Analytics is limited by the Google Analytics Terms of Service and Privacy Policy. 4 Use of your personal data
We collect and use personal information for a range of purposes, including to:
a) deliver products and process payment for the products
b) respond to your inquiries and provide you information about our products
c) if you enter one of our competitions or promotions, we will administer your participation in that competition or promotion
d) deal with any complaints or feedback you have
e) manage our relationships with our business customers, suppliers and contractors; and
f) consider jobseekers for current and future employment.
We may use your information for other purposes required or authorized by law (including purposes for which you have given your consent), for the purpose of other legitimate interests or in order to comply with a legal duty imposed on us. If we are unable to collect personal information from or about you, we may not be able to respond to your inquiries or requests or do business with you.
If you have given approval to receive newsletters or SMS for marketing purposes, we may use your personal information to contact you with 2XU news, offers and information about our products and events. When you sign up for our newsletter or SMS, you agree that we use your personal information, such as your email address of phone number, for direct marketing purposes. This includes sending you promotional emails or SMS. You can opt out of receiving direct marketing communications at any time by using the unsubscribe function located at the bottom of each newsletter or by replying STOP to SMS or by contacting us via info.nordics@2xu.com.
5 Processing of personal data
In this section, we describe how we process your personal data more in detail.
Customers or potential customers
A) Purpose: Processing orders from customers.
Type of processing: This includes processing for delivery (including notifications and contacts concerning the delivery), processing of orders from customers, identifying customers, processing payment and processing complaints and warranty claims.
Categories of personal data: Name, social security number, contact information (such as e-mail address and phone number), payment information, purchase information (i.e. which product has been ordered or whether the product should be delivered to another address).
Categories of data subjects: Customers.

Lawful basis: Completion of order. This gathering of your personal data is required in order for us to be able to fulfil our commitments as agreed. If the information is not provided, our commitments cannot be fulfilled and we may terminate the agreement.

Data retention: Until the agreement has been performed (including delivery and payment) and for a time of up to 36 months thereafter with the purpose of processing complaints or warranty claims.
B) Purpose: To fulfil the company’s legal obligations regarding purchase of goods or services.
Type of processing: This includes the necessary processing for fulfilling the company’s legal obligations according to law, court rulings (e.g. the Book-keeping Act) or decisions by authorities.
Categories of personal data: Name, social security number, contact information, payment history, payment information.
Categories of data subjects: Customers.

Categories of personal data: Name, social security number, contact information, correspondence with the customer or customer’s representative. Information on purchase time, potential defects/complaints.

Type of processing: This includes e.g. marketing mailings regarding our products and services via e-mail, sms and by post.
Categories of personal data: Name, contact information.
Categories of data subjects: Customers, potential customers.

Lawful basis: Consent and legitimate interest. The processing is necessary to cater our interest in marketing our products and services.
Automated decision making: This processing does not imply that decisions will be made based on automatic processing of personal data.
Data retention: One year from the last contact. Longer after consent.
Suppliers
Purpose: In order to communicate with contact persons for suppliers and partners.
Type of processing: This includes e.g. processing deliveries and cooperation as well as providing an organizational chart and telephone list in order to collaborate internally within the company. Supplier directory for easier access to contact information.
Categories of personal data: Name, contact information.
Categories of data subjects: Suppliers and their representatives.

Lawful basis: Legitimate interest. The company has a legitimate interest in processing the personal data necessary in order to communicate with contact persons for suppliers and partners.

Data retention: Until we have received information that the contact person has quit or changed contact information, or for as long as the contractual relationship remains.
Job seekers
Purpose: In order to administer a recruitment process.
Type of processing: This includes e.g. to review the application and communicate with the applicant.
Categories of personal data: Name, social security number, contact information, proof of identity, information on jobseeker’s performances and prior work experience.
Categories of data subjects: Jobseekers.

Lawful basis: Until the position is appointed: completion of the agreement. After the position has been appointed: legitimate interest (or consent).
Automated decision making: This processing does not imply that decisions will be made based on automated processing of personal data.
Data retention: Up to two years from when the position was appointed. Following completed recruitment process, the information is filed in order to be used at a potential appeal of the recruitment in accordance with e.g. non-discrimination legislation. When there is no longer a possibility to appeal, the information will be destroyed unless there is consent to continued processing.
6 Information to third parties
The information collected is used by us and the partners we work with depending on which channel you have contacted us through. We may sometimes need to disclose personal information to third parties. These include, where appropriate, internally our related bodies corporate and third parties that provide services to us, including parties that provide our payment gateway, marketing, logistics and IT support services. We may also disclose your personal information to other third parties and for other purposes where we are required or authorized by or under law to do so (including where you have provided your consent).
Some of our related companies and service providers are located abroad. As a result, personal information collected and held by us can be transferred outside Sweden to countries that do not have adequate data protection level. The transfer of personal data to such a country shall only take place if contractual clauses (e.g. EU Model Clauses, Privacy Shield, etc.) have been put into place.
We have signed agreements that include provisions on the processing of personal data on behalf of KMP Online AB with selected goods and service suppliers, such as IT suppliers.
To carry out the order on the online store, we work with Shopify Payments, which takes care of our payment solution.
We will share the personal information to transport companies such as Postnord that is required to be able to complete and deliver your order.
When you send e-mail to our customer service, we will handle and store the personal data such as. first and last name and e-mail or other information that you provide yourself as well as the e-mail history.
If you have chosen to subscribe to the 2XU Newsletter, your e-mail, name and any other information that you have provided to us in connection with subscribing to the 2XU Newsletter will be saved. The information is stored in accordance with the laws of the Data Protection Regulation.
Ifyou agree to receive text messages (SMS), you agree to receive recurring automatedmarketing messages, including cart reminders, at the phone number provided. Your consent is not a condition of purchase. You can unsubscribe to this service at any time by answering STOP. Message frequency varies. Msg & data rates may apply.
You can be assured that we will not share or sell personal information on to third parties for marketing purposes. We mainly use partners and third parties within the EU / EEA area to process and store the information.
Please note that the web shop may contain links to other web pages. We are not responsible for the personal data policy or processing of your personal data on third party websites. We recommend that you read the personal data policy that applies to that website.
7 Data processing rules
We process your personal information in compliance with the Data Protection Regulation, which is based on the processing principles set out below. Personal information must be:
a) processed lawfully, fairly and in a transparent manner.
b) collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes.
c) adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.
d) accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that is inaccurate, having regard to the purposes for which they are processed, is erased or rectified without delay.
(e) kept in a form which permits identification for no longer than is necessary for the purposes for which the personal data is processed.
(f) processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.
8 Security
We take reasonable steps to protect the personal information we hold against loss, unauthorized access, use, modification or disclosure and against other misuse. This includes taking appropriate security and organizational measures to protect electronic materials and materials stored and generated in hard copy.
We use appropriate firewalls and antivirus software to protect and prevent unauthorized access. The website uses SSL (Secure Socket Layer) which is a protocol for secure data transfer. SSL uses digital certificates to control the sender and receiver of the data transmission.
9 Your rights and correction / removal of personal data
According to the Data Protection Regulation, you have the following rights:
a) the right to be informed about the collection and use of personal data by us.
b) the right to access the personal data we hold about you.
c) the right to rectification if any personal data we hold about you is inaccurate or incomplete.
d) the right to be forgotten, i.e. the right to ask us to delete any personal information we hold about you.
e) the right to restrict (i.e. prevent) the processing of the personal data.
f) the right to data portability (obtaining a copy of the personal data to re-use with another service or organization).
(g) the right to object to us using the personal data for particular purposes; and
(h) the rights with respect to automated decision-making and profiling (where applicable).
You can always request correction, extracts and that we delete your information from our register by writing an e-mail to info.nordics@2xu.com. Upon written request, we remove the customer information from our customer register, unless it is information that is mandatory and required to be saved for accounting or lawful reasons.
10 Complaints
Please contact us (see contact details in section below) if you have any concerns or complaints about how we have collected or handled your personal information. We will ask you about your complaint and respond in writing within 30 days. If you are not satisfied with our response, you can contact us to discuss your concerns or make a complaint to the competent supervisory authority.
